2. General Provisions
2.1. Scope of Terms
These General Terms and Conditions (hereinafter: Terms) apply to the web development, website creation, webshop development, process automation, and related IT services provided by Farkas Márk (tax-registered individual) (hereinafter: Provider).
By placing an order, the Client automatically accepts these Terms. The Client expressly accepts the provisions of these Terms during the inquiry, order, or contract signing process.
2.2. Definitions
- Provider: Farkas Márk (tax-registered individual), who provides web development services
- Client: Any natural or legal person who uses the Provider's services
- Parties: Provider and Client collectively
- Project: The subject of the specific order (website, webshop, other application)
- Handover: The Client's acceptance of the completed project
3. Services and Pricing
3.1. Service Packages

⚠️ Important: Listed prices are indicative and net (VAT exempt). Final pricing is always determined in an individual proposal based on project complexity.
4. Order Process
4.1. Getting in Touch
The order process can be initiated through:
- Filling out the contact form on the website (https://markfarkas.hu)
- Sending an email to info@markfarkas.hu
- Phone inquiry: +36 30 371 5204
- Booking an appointment via Google Calendar
4.2. Quote Request
After initial contact, the Provider responds within 24 hours, discusses project details with the Client, and prepares a detailed written proposal including: project description, features, deadlines, pricing, and payment terms.
4.3. Contract Formation
The contract is formed when the Client accepts the proposal (email, signature), pays the deposit, and the Provider begins work.
5. Payment Terms
5.1. Payment Methods
- Bank transfer (recommended)
- PayPal
- Cash (upon personal handover)
5.2. Payment Schedule
Smaller projects (<300,000 HUF):
- 50% deposit upon contract signing
- 50% upon handover
Larger projects (≥ 300,000 HUF):
- 30% deposit upon contract signing
- 40% during design and development (milestone)
- 30% upon handover
Monthly maintenance: Due on the 1st of each month, payable by bank transfer or automatic debit.
5.3. Late Payment
If the Client misses the payment deadline, the Provider may suspend work, charge late payment interest (5% annually per Hungarian Civil Code), and may withdraw from the contract after 30 days of delay.
6. Delivery and Fulfillment
6.1. Delivery Timelines

Timelines are counted from contract signing and deposit receipt. Exact deadlines are specified in the individual proposal. In case of force majeure, deadlines are extended proportionally.
6.2. Handover
The Provider notifies the Client upon project completion. The Client has 5 business days to test and report feedback. The Provider provides 2 rounds of free revisions. After final handover, warranty bugs are fixed free of charge within 30 days.
7. Client Obligations
7.1. Content and Materials
The Client is obligated to provide project materials (texts, images, logo) in a timely manner, take responsibility for the legality of content, ensure usage rights for copyrighted materials, and provide access credentials.
7.2. Cooperation
The Client agrees to actively cooperate, respond to the Provider's questions in a timely manner (within 3 business days), and provide constructive feedback.
⚠️ Delay: If the Client fails to provide timely feedback or materials, the project deadline is extended proportionally. In case of delay exceeding 30 days, the Provider may terminate the contract and claim proportional payment for work already completed.
8. Copyright and Licensing
8.1. Intellectual Property
Source code, design, and graphic elements created by the Provider are protected by copyright. Upon full payment:
- The Client receives unlimited, exclusive usage rights for the project
- The Client may freely use, modify, and further develop the project
- The Client may not sell the source code to third parties in identical form
8.2. Portfolio Usage
The Provider is entitled to feature the project in their portfolio, reference the Client in their reference list, and create screenshots. If the Client does not wish this, they must notify the Provider in writing beforehand.
9. Warranty and Liability
9.1. Warranty
- 3 months from project handover: free bug fixes and maintenance
- 1 year: warranty on code quality and functionality
Not covered by warranty: errors caused by Client or third-party modifications, hosting/domain provider errors, external API errors, viruses, hacking, or other external attacks.
9.2. Limitation of Liability
The Provider is not liable for the illegal nature of content provided by the Client, infringement of third-party copyrights, business losses, lost profits, or indirect damages. The Provider's maximum liability is limited to the project fee amount.
10. Right of Withdrawal
10.1. 14-Day Right of Withdrawal
A Client qualifying as a consumer may withdraw from the contract within 14 days of contract formation without giving reasons, except if work has already begun at the Client's express request.
10.2. How to Withdraw
The right of withdrawal must be exercised in writing (email: info@markfarkas.hu). Upon withdrawal, the Provider refunds the paid amount within 14 days, deducting proportional fees for work completed and costs incurred.
10.3. Provider's Right of Withdrawal
The Provider may withdraw from the contract if the Client fails to pay on time (after 30 days of delay), fails to cooperate (no response for 30 days), or requests publication of illegal content.

11.3. Purpose of Data Processing
- Communication: Answering client inquiries
- Proposals: Preparing and sending custom proposals
- Contract fulfillment: Project execution and invoicing
- Legal obligation: Data retention per accounting laws
- Statistics: Anonymized website traffic measurement
- Marketing: Newsletter sending (only with prior consent)
11.4. Data Transfers
The Controller does NOT share data with third parties, except:
- Google Analytics: Anonymized visitor statistics (with IP anonymization)
- Email provider: Required for sending emails (SMTP server)
- Legal obligation: Upon authority request
11.5. Data Subject Rights
- Right of access: Request information about processed data
- Right to rectification: Correction of incorrect data
- Right to erasure: Exercise the "right to be forgotten"
- Right to restriction: Request restriction of processing
- Right to object: Object to data processing
- Right to data portability: Receive data in machine-readable format
- Right to remedy: File a complaint with NAIH (Hungarian Data Protection Authority)

11.7. Data Security

12. Dispute Resolution
12.1. Complaint Handling

12.2. Consumer Protection

12.3. Governing Law
The contract is governed by Hungarian law, in particular: Act V of 2013 (Civil Code), Act CVIII of 2001 (E-Commerce), GDPR, Act CXII of 2011 (Information Self-Determination).
13. Final Provisions
The Provider is entitled to unilaterally amend these Terms. Clients will be notified by email of any amendments. Amendments take effect on the 15th day following publication.
These Terms take effect on October 27, 2025 and remain valid until revoked.
